Sponsor: The Sweepstakes is sponsored and administered by CNH America LLC, 700 State Street, Racine, Wisconsin, 53404, and in Canada, CNH Canada Ltd. (4475 North Service Road, Burlington, ON L7L4X7) (“Sponsor”).
1. To Enter: The Case Construction 2009 Rockin’ Block Party Skid Steer Sweepstakes (the “Sweepstakes”) begins at 12:00:00 a.m. Eastern Standard Time (EST) on April 15, 2009 and ends at 11:59:59 p.m. EST on November 30, 2009 (the “Sweepstakes Entry Period”). To enter the Sweepstakes, visit a participating authorized Case Construction Equipment dealer in the United States or Canada (except Quebec) during the Sweepstakes Entry Period and during that dealer’s authorized open house “Block Party” event and complete a physical entry form with all required information (name, address, phone number, e-mail address, age, and name of eligible construction company at which Entrant is employed (including employer’s address and phone number)) and submit your signed entry as instructed. Entrants must pre-qualify for a demo of a new piece of Case construction equipment in order to be eligible to submit an entry into the Sweepstakes. Limit one entry per person; however, eligible construction companies may have more than one eligible employee submit an entry. Each Entrant’s signature on the entry form certifies that he/she has received a copy of the Official Rules, has read and understands the rules prior to signing, and agrees to abide by all Sweepstakes rules. Sponsor is not responsible for: i) lost, late, incomplete, illegible, damaged, garbled, destroyed, or misdirected entries or mail, or entries not received by Sponsor for any reason; ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries, or for destruction of or unauthorized access to, or alteration of, entries; iii) causes beyond Sponsor’s control that jeopardize the administration, security, fairness, integrity or proper conduct of this Sweepstakes; or (iv) any entries submitted in a manner that is not expressly allowed under these Official Rules. All incomplete or otherwise non-conforming entries will be disqualified.
2. Eligibility: The Sweepstakes is open to and may be entered by individuals who are employed by an eligible construction company and are in the construction business as a primary occupation at the time of entry, are the legal age of majority as of the date of their entry into the Sweepstakes, and are legal residents of one of the 50 United States/D.C. or Canada (excluding Quebec). “Eligible construction company” means any construction company that owns or operates one or more pieces of construction equipment. “Construction equipment” means any equipment of the type manufactured by Sponsor under the Case brand. The Sweepstakes Prize will be awarded to the eligible construction company at which the individual Entrant is employed. Proof of eligibility will be required. The general public not employed by an eligible construction company as well as employees of Sponsor, its subsidiaries, affiliates and dealers, and their immediate families (spouse and parents, siblings and children, and each of their spouses, regardless of where they live) and persons living in the households of each of these individuals, whether related or not, are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state, provincial and local laws and regulations.
3. Drawing: Four (4) Sweepstakes winners will be selected from among all eligible entries received in accordance with these Official Rules in a random drawing conducted on Dec. 14, 2009 in Racine, Wisconsin (“Drawing”), by the Sponsor. Three (3) winners will be chosen from the U.S. – one (1) each from Sponsor’s U.S. regions (East, Central and West), and one (1) winner will be chosen from Sponsor’s region comprising all of Canada (except Quebec). The winning Entrant from Canada will be contacted by telephone and must correctly answer a timed mathematical skill question in order to be declared the winner. Winners need not be present to win.
4. Odds: Actual odds of winning a Prize depend upon the total number of eligible Entrants who correctly register for the Drawing.
5. Prizes: The Prizes consist of four (4) 2009 Case 430 Skid Steers, with the following specifications: 07W 430 skid steer loader; 2D single speed; 3C hydraulic coupler; 4J handles; 5D deluxe cab w/heat & AC; 6L suspension seat; 7CA 12x16.5 XD2002 tires; 8C 66” foundry bucket; 9B decals, English, USA; 10CB 66” cutting edge; 10PN pilot controls, H pattern; 10RC ride control; 10SZ two speed. Approximate retail value of the each skid steer is USD$47,556 / CAN$64,200. Sponsor reserves the right to substitute a different model at its sole discretion. Total Prize Pool = USD$142,668 plus CAN$64,200.
6. Prize Restrictions: All Prizes will be awarded to and in the name of Entrant’s eligible construction company employer, and are not transferable. No substitution or cash equivalent of Prizes permitted except at the sole discretion of Sponsor. Sponsor will allow the winning eligible construction equipment companies, in lieu of accepting the Case 430 skid steer Prizes as specified above, to apply a credit for the retail value of the Case 430 skid steer (USD$47,556 / CAN$64,200) towards the purchase of a new Case 400 Series 3 skid steer specified in the manner of their choosing, depending on availability. Federal, state, provincial and local taxes and any registration, license, fees and/or other costs and expenses related to the acceptance and/or use of a Prize are the sole responsibility of each winning eligible construction company. The winning eligible construction company must have licensed operators and meet all other requirements or the Prize will be forfeited.
7. Prize Claims: The winning eligible construction companies will be contacted by telephone, mail and/or e-mail within approximately seven (7) days after the Drawing. Winners are subject to verification, including verification of age. The winning Entrants and their eligible construction companies will be required to complete and sign an Affidavit of Eligibility & Liability Release (for Canadians, a Declaration of Compliance) and, where legal, a Publicity Release, which must be completed within seven (7) days of notification or the Prize will be forfeited and awarded to alternate winners. EACH WINNING ELIGIBLE CONSTRUCTION COMPANY MUST ACCEPT DELIVERY OF ITS PRIZE AT A DEALERSHIP DESIGNATED BY SPONSOR WITHIN THIRTY (30) DAYS OF NOTIFICATION OR PRIZE WILL BE FORFEITED. If a Prize notification letter or Prize is unclaimed or returned as undeliverable, the Prize may be forfeited and awarded to an alternate winner. Sponsor is not responsible for any change of mailing address and/or telephone number of entrants.
8. Use of Information Gathered: Information gathered from the Competitors may be used for future marketing purposes, but will not be sold.
9. Disclaimer: Sponsor has the authority to change or cancel this Sweepstakes in whole or in part and to change the eligibility rules at any time, without prior notice to or the consent of any person or Entrant having a beneficial interest in the Sweepstakes. Similarly, Sponsor retains its sole and absolute discretionary authority to resolve all questions arising in the administration, interpretation and application of this Sweepstakes. This authority includes but is not limited to construing the terms of this Sweepstakes, including any disputed or doubtful terms, and determining the eligibility of any Entrant to participate in this Sweepstakes or the eligibility of any construction company to receive any Prize or other benefit. Sponsor’s determination will be conclusive and binding on all persons.
10. Additional Terms: By participating in this Sweepstakes, Entrants agree: a) these Official Rules and the decisions of the Sponsor shall be final and binding in all respects; b) to release, discharge, indemnify and hold harmless Sponsor, its affiliates, subsidiaries, and dealers, their respective subsidiaries, affiliates, officers, directors, and employees from any liability, claims, or damages arising out of their participation in the Sweepstakes and the acceptance, use, misuse, or possession of any Prize; and c) under no circumstances will Entrant or any winning eligible construction company be permitted to obtain awards for, and Entrant hereby waives all rights to claim against Sponsor, punitive, incidental, consequential, or any other damages. By accepting a Prize, each Entrant and winning eligible construction company agrees to, where legal, Sponsor's and its designees' use of its name, pictures/photographs/likenesses, and/or voice recordings for advertising and publicity purposes without compensation and, upon request, will provide consent to such use in writing. The winners must comply fully with these Official Rules in order to receive the Prizes.
11. Limitation of Liability: Sponsor is not responsible for printing or typographical errors in any Sweepstakes-related materials, entry forms, etc. Sponsor reserves the right to cancel or modify the Sweepstakes if fraud or technical failures compromise the integrity of the event as determined by Sponsor in its sole discretion. By accepting this Prize, the winning eligible construction companies further acknowledge that Sponsor and its agents, their respective parent companies, affiliates and subsidiaries, and the officers, directors, agencies, agents and employees of each of the foregoing, have neither made, nor are in any manner responsible or liable for, any warranty (other than Sponsor’s standard warranty for products such as the Prizes), representation or guarantee, express or implied, in fact or in law, relative to such Prizes including, but not limited to, their quality, condition or fitness for a particular purpose. If for any reason this Sweepstakes cannot be executed as planned, for reasons including but not limited to tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that corrupt or affect the security, administration, fairness, integrity, or proper conduct of this Sweepstakes, or if this Sweepstakes is compromised or becomes technically corrupt in any way, electronically or otherwise, Sponsor reserves the right to terminate the Sweepstakes in its sole discretion. If the Sweepstakes is terminated before the scheduled end date, Sponsor may, in its discretion, select the Prize winners by random drawing from among all eligible, non-suspect entries received as of the termination date/time. Sponsor reserves the right, at its sole direction, to disqualify and prosecute any individual who tampers with or attempts to tamper with the entry process.
12. Copy of Rules / Winner List: For a copy of these rules or for the names of the winners of this Sweepstakes, mail a self-addressed, stamped envelope to: Case Marketing, CNH America LLC, 700 State Street, Racine, WI 53404. Requests must be received by March 1, 2010.
13. Name Removal: If you would like your name removed from the list of future sweepstakes or contest mailings, please write to Case Marketing, CNH America LLC, 700 State Street, Racine, Wisconsin, 53404.
14. Jurisdiction: Any claims or lawsuits related to the Sweepstakes brought against Sponsor shall be brought in the federal or state courts of Wisconsin, and shall be governed by the laws of Wisconsin without giving effect to any choice of law or conflict of law rules. By participating in this Sweepstakes, all Entrants agree to the jurisdiction and venue of such courts, and waive all objections to such jurisdiction and venue.
